CHAPTER 7
A Chapter 7 bankruptcy allows debtors who meet income guidelines to obtain relief from most unsecured debt, such as credit cards, medical bills and auto repossession deficiencies.  However, certain types of debts, such as most taxes, student loans and domestic support obligations, are not “discharged” in a bankruptcy.  As long as the value of an individual’s assets are within limits set by bankruptcy law, those assets can often be retained and shielded from creditors.

CHAPTER 13
A Chapter 13 bankruptcy is designed for individuals with regular income who wish to repay part or all of their debts over time, typically 5 years.  This type of bankruptcy often allows individuals to cure a mortgage deficiency over the 5 year life of a typical repayment plan, which must be proposed by the individual and approved by the court.  If the individual successfully completes the confirmed plan, they can often bring their mortgage current and retain their home.  An individual can file this type of bankruptcy if their debts are below certain limits set by Bankruptcy law.
